وعندما تنشئ الجماعات المسلحة من غير الدول أنظمة موازية للسلطة، يختل هذا التوازن. ولا تقتصر تداعيات ذلك على السياسة والأمن، بل تمتد بصورة مباشرة إلى الحياة اليومية للأفراد، فتقيّد حرياتهم، وتضعف فرصهم الاقتصادية، وتعرّض حقوق الإنسان الأساسية للخطر.
سيادة القانون في مواجهة حكم القوة
يعتمد المجتمع الذي تحكمه سيادة القانون على مؤسسات تطبق العدالة على قدم المساواة، وتحمي كل فرد دون خوف أو تمييز. لكن عندما تعمل الجماعات المسلحة خارج الأطر القانونية، قد تحل الأسلحة محل التشريعات، والنفوذ محل المساءلة.
وقد يجد المواطنون أنفسهم يعيشون في حالة من عدم اليقين، تصبح فيها السلامة الشخصية، وحرية التعبير، والوصول إلى العدالة مرهونة بسلطة الجهات المسلحة، بدلاً من أن تكون محمية من خلال مؤسسات مستقلة.
ولا يمكن لسيادة القانون أن تتحقق في مجتمع تعمل فيه بعض الجماعات فوق مستوى المسؤولية القانونية. فالسلام المستدام يتطلب إخضاع جميع الأفراد والمنظمات للمعايير ذاتها من العدالة والمساءلة.
الكلفة الإنسانية لعدم الاستقرار
يقاس تأثير الجماعات المسلحة في نهاية المطاف بحجم المعاناة التي يتحملها الناس العاديون.
فالحرية لا تقتصر على المشاركة السياسية أو التعبير العلني، بل تشمل أيضاً حرية بناء الحياة، واختيار المهنة، وكسب الرزق، وإنشاء الأعمال، وتعليم الأبناء، والمساهمة في المجتمع دون ترهيب أو خوف.
وعندما ينتشر انعدام الأمن، تتراجع الفرص الاقتصادية. وينخفض الاستثمار، وتصبح فرص العمل أكثر هشاشة، وتفقد المجتمعات ثقتها بالمستقبل. وغالباً ما تكون النتيجة الفقر والنزوح والتآكل التدريجي للثقة الاجتماعية.
حماية الحرية من خلال مؤسسات قوية
لا يكمن حل عدم الاستقرار في استعادة الأمن فحسب، بل في بناء مؤسسات تحترم حقوق الإنسان وتخدم المواطنين على قدم المساواة.
ويجب على المجتمع الناجح أن يضمن:
1. تطبيق القانون على الجميع
لا ينبغي لأي فرد أو منظمة أو جماعة مسلحة أن تكون فوق المساءلة القانونية.
2. حرية التعبير والرأي
يجب أن يمتلك الناس الحق في مشاركة أفكارهم، والنقاش بصورة مفتوحة، والمشاركة في الحياة العامة دون خوف.
3. الحق في العمل والفرص الاقتصادية
يجب أن يتمتع المواطنون بحرية السعي إلى العمل، وريادة الأعمال، وتأمين حياة كريمة.
4. حماية حقوق الإنسان
يجب أن تحمي أنظمة العدالة الأفراد من الانتهاكات والتمييز والأفعال غير القانونية.
مسؤولية عالمية
إن تحدي الجهات الفاعلة المسلحة من غير الدول لا يقتصر على دولة أو منطقة بعينها، بل يمثل قضية عالمية ترتبط بالمبادئ العالمية لحقوق الإنسان والسلام والتنمية البشرية.
